Digital Millennium Copyright Act (DMCA) Policy

Notice of Copyright Infringement

BioFit RX respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their authorized agents may submit a takedown request if they believe that copyrighted content has been used without permission.

To file a good faith infringement claim, please send a notice that includes the following:

  1. A physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
  2. Identification of the copyrighted work that is allegedly being infringed.
  3. Identification of the infringing material that needs to be removed (please include the specific URL where it appears).
  4. Your contact information, including your full name, mailing address, email, and phone number.
  5. A statement that you have a good faith belief that the use of the material is unauthorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notification is accurate and that you are authorized to act on behalf of the copyright owner.

By submitting a DMCA notice, you acknowledge that BioFit RX may share your complaint, including your contact information, with the alleged infringer.

Counter Notification – Restoration of Material

If you believe that content was wrongfully removed, you may file a counter-notification in accordance with 17 U.S.C. § 512(g)(3). Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the original location of the material before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed due to mistake or misidentification.
  4. Your contact information (name, address, phone number, and email).
  5. A statement consenting to the jurisdiction of the federal district court for your location (or, if outside the U.S., any jurisdiction where BioFit RX may be found) and that you agree to accept service of process from the person who filed the original infringement complaint.

Once we receive a valid counter-notification, we may restore the removed content unless we receive notice that the original complainant has filed a court action against you.

Repeat Infringer Policy

BioFit RX strictly enforces its policy against repeat infringers. Users who receive multiple copyright complaints may have their accounts terminated and their access to our services revoked. We maintain a record of DMCA notices and take action accordingly.

Modifications to This Policy

BioFit RX reserves the right to modify this DMCA policy at any time. Users are encouraged to check this page frequently for updates.
